Gene O’Connor is committed to
providing the highest quality
legal services to his clients
and achieving favorable results.
He has more than two decades of
experience practicing law in the
areas of commercial bankruptcy,
loan restructuring, creditors’
rights, and commercial
litigation. His primary area of
concentration has been in
representing banks, financial
institutions, leasing companies,
and other creditors.
Prior to founding Folks &
O’Connor, PLLC, Mr. O’Connor
was, for nine years, a Vice
President and assistant general
counsel of JPMorgan Chase Bank,
N.A. (formerly Bank One, NA) and
was responsible for managing all
of Chase Bank’s commercial
bankruptcy and loan
restructuring/workout matters in
Arizona, Colorado and Utah.
While at Chase Bank, he
represented Chase Bank in
numerous large and complex
Chapter 11 reorganizations and
other bankruptcy proceedings.
Additionally, Mr. O’Connor
documented many high-dollar
commercial loan restructurings
for Chase Bank's Middle Market
and Large Corporate lines of
business. Mr. O’Connor was also
involved in documenting several
complex commercial loan sale
transactions for Chase Bank.
Before joining Chase Bank, Mr.
O’Connor practiced for seven
years with the bankruptcy
department at Snell & Wilmer,
L.L.P., the largest law firm in
Arizona. During this time, he
represented banks and other
financial institutions in
Chapter 11 reorganizations and
other bankruptcy proceedings.
Mr. O’Connor also handled
federal and state court
litigation cases as well as
collection cases for his
clients.
Mr. O’Connor started his career
in New York, as an associate
attorney with the prestigious
Wall Street law firm of Stroock
& Stroock & Lavan. His
experience in that firm's
insolvency department was
invaluable, providing him with
the opportunity to represent
clients in a number of very
significant bankruptcy and
reorganization proceedings,
including Texaco Inc., Coleco
Industries Inc., LTV Steel
Corporation, Johns-Manville
Corporation, and Wheeling
Pittsburgh Steel Corporation.
During his more than 20 years of
practice, Mr. O’Connor has had
significant experience in the
following areas:

Representing banks,
financial institutions,
leasing companies and
other creditors in
Chapter 11, Chapter 7
and Chapter 13
bankruptcy proceedings.

Prosecuting and
defending commercial
litigation cases in both
federal and state court.

Documenting complex loan
restructuring
transactions, including
preparing forbearance
agreements, loan
modification agreements,
collateral assignments,
and related documents.

Representing clients in
adversary proceedings
and contested matters in
bankruptcy cases,
including preference,
fraudulent transfer, and
other avoidance actions.

Pursuing lawsuits on
defaulted promissory
notes and guarantees.

Conducting judicial and
nonjudicial foreclosure
actions, and Uniform
Commercial Code personal
property sales.

and loan sale
transactions.
