Residential Mortgage Foreclosures

Folks & O’Connor is one of the leading law firms in Arizona that represents banks and mortgage companies on a high-volume basis concerning foreclosures upon residences in the Phoenix area and throughout Arizona.

Our attorneys also have significant experience in representing clients in a broad range of Arizona loss mitigation and default servicing matters. More specifically, our lawyers routinely represent clients in every Arizona county to:

  • conduct non-judicial trustee’s foreclosure sales;

  • litigate judicial foreclosures and quiet title actions;

  • monitor senior lien foreclosure sales and bid at such sales to protect our clients’ junior lien positions;

  • deposit and apply for excess foreclosure sale proceeds;

  • document deeds-in-lieu of foreclosure, loan forbearance agreements, loan modification agreements, and loan sale agreements; and

  • litigate post-foreclosure evictions.

At its central Phoenix offices, Folks & O'Connor is highly automated to allow it to process a high volume of Arizona residential mortgage foreclosures and evictions. In particular, the firm utilizes a sophisticated internal software program, specific to Arizona non-judicial trustee’s foreclosure sales, which allows our staff members to process foreclosure sales on a virtually automated basis and with protective calendaring safeguards in place to protect our clients. The program also allows our clients to obtain current status updates concerning their Arizona foreclosure referrals to the firm over the internet. The firm is also very experienced with the use of the DataCert, Examen, iClear, LenStar and VendorScape billing and client reporting systems.

Larry O. Folks is our firm's lead residential mortgage foreclosure and eviction attorney. He is a graduate of the Northwestern University School of Law and a former partner of Kutak Rock, LLP, which is a national law firm. In addition, he has been an Arizona foreclosure trustee for many years and is a member of the Arizona Trustee’s Association. Mr. Folks and his seasoned staff have successfully completed thousands of residential mortgage foreclosures in the Phoenix area during the past 10 years.

Our firm is not a foreclosure mill and is highly responsive to our clients’ needs. In fact, we routinely receive monthly scorecard ratings of 100% from one of our national banking clients, which directly reflects the firm’s ongoing ability to complete non-judicial trustee’s foreclosure sales of Arizona residences in advance of the applicable FNMA timeline requirements.

Foreclosure Fees

Our law firm typically completes non-judicial trustee’s foreclosure sales and other foreclosure-related services concerning residences for the applicable FNMA “flat fee” for such services.

Commercial Foreclosure

Folks & O'Connor has significant experience in completing non-judicial trustee’s foreclosure sales and judicial foreclosures on Arizona commercial properties. In addition to being a seasoned litigator, Mr. Folks has a number of years of commercial real estate transactional experience, which assists him in completing commercial foreclosures. He recently prevailed in a highly contested judicial foreclosure on a high-rise commercial office building in Phoenix.
